General conditions of use of the site www.gradconcept-prescription.com

Article 1: object

These general conditions of use (hereinafter "CGU") define the conditions of access and use of the services of the website  https://www.gradconcept-prescription.com  (hereinafter "the Site") by users (hereinafter "the User") offered on the Site to enable them to purchase the products presented on the Site.

The T&Cs are accessible on the Site under the heading  general conditions of use  and supplement the General Conditions of Sale which govern the sales made between customers and the company BURGER & CIE, owner of the Site.

ARTICLE 2 – Scope

The T&Cs apply, without restriction or reservation, to the use of the services and technological tools made available to Users of the Site.

The T&Cs are accessible at any time on the Site and will prevail, where applicable, over any other version or any other contradictory document.

As the T&Cs may be subject to subsequent modifications, the version applicable to a transaction carried out between a User and the company BURGER & CIE is that in force on the Site on the date the order is placed.

Changes to these T&Cs are enforceable against users of the Site from the time they are put online and cannot be applied to transactions entered into previously.

By browsing the Site, the User certifies having read and understood the T&Cs and the privacy policy. He accepts the conditions, more particularly with regard to the collection and processing of his personal data. The User may oppose it by contacting the publisher at the email address:  rgpd@burger.fr .

Any registration or use of the Site implies acceptance without any reservation or restriction of the T&Cs by the User. When registering on the Site via the registration form, each User expressly accepts the T&Cs by ticking the box preceding the following text: "I acknowledge having read and understood the T&Cs and I accept them".

The company BURGER ET CIE acting as publisher of the Site, it publishes by making the pages of the Site available to Users by selecting the contents, assembling them, prioritizing them and formatting them on the Site.

Article 4 – Access to the site

The Site is accessible worldwide, from any location, 7/7 days, 24/24 hours except in cases of force majeure or in the event of scheduled or unscheduled interruption of the Site which may arise from a possible need for maintenance.

The User is responsible for updating the information provided. It is specified to him that he can modify them by connecting to his member area. To access the services, the User must identify himself using his username and password, which are strictly personal. As such, it prohibits any disclosure. Otherwise, he will remain solely responsible for the use that will be made of it.

The User may also request to unsubscribe by going to the dedicated page on his personal space or by sending an email to:  service.clientburger@burger.fr

This will be effective within a reasonable time. In the event of non-compliance with the T&Cs or the general conditions of sale of the company BURGER & CIE, the latter has the possibility of suspending or even closing the account of a User after formal notice sent by electronic means and which has had no effect. .

Any deletion of an account, for whatever reason, results in the pure and simple deletion of all personal information of the User. Any event due to a case of force majeure resulting in a malfunction of the Site or server and subject to any interruption or modification in the event of maintenance, does not engage the responsibility of the company BURGER & CIE.

In these cases, the User agrees not to hold BURGER & CIE harmless for any interruption or suspension of service, even without notice. The User has the option of contacting BURGER & CIE by e-mail at the following e-mail address  service.clientburger@burger.fr .  

ARTICLE 5: Personal data

 

The Site provides the User with the collection and processing of personal information in compliance with the provisions of Law 78-17 of January 6, 1978 amended by Law No. 2018-493 of June 20, 2018.

Any total or partial reproduction of this content is strictly prohibited and is likely to constitute an offense of counterfeiting.

The User must seek the prior written authorization of BURGER & CIE for any reproduction, publication, copy of the various contents.

ARTICLE 7: Liability

The sources of the information disseminated on the Site are deemed reliable but the Site does not guarantee that it is free from faults, errors or omissions. The information provided is presented for information and general purposes without contractual value.

Although the information published on the Site is deemed reliable, BURGER & CIE does not guarantee the reliability of the sources.

BURGER & CIE cannot be held responsible for the use and interpretation of the information contained on the Site.

The Site cannot be held responsible for any viruses that could infect the computer or any computer equipment of the User, following use, access, or download from this Site.

BURGER & CIE cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.

Hypertext links may be present on the Site.

The User is informed that by clicking on these links, he will leave the Site.

BURGER & CIE has no control over the web pages to which these links lead and cannot, under any circumstances, be held responsible for their content.

SECTION 9: Cookies

ARTICLE 10 – Partial nullity

If one or more stipulations hereof are held to be invalid or declared as such pursuant to a law, regulation or final decision of a competent jurisdiction, the other stipulations shall retain their full force and scope. .

THESE GENERAL CONDITIONS OF USE AND THE OPERATIONS RESULTING FROM THEM ARE GOVERNED BY FRENCH LAW.

THEY ARE WRITTEN IN FRENCH. IN THE EVENT THAT THEY ARE TRANSLATED INTO ONE OR MORE LANGUAGES, ONLY THE FRENCH TEXT WILL BE AUTHENTIC IN THE EVENT OF A DISPUTE.

ANY DISPUTE RELATING TO THE INTERPRETATION AND/OR EXECUTION OF THESE T&Cs IS SUBJECT TO THE COURTS OF THE JUDICIAL COURT OF COLMAR.
